Project Title: STATE ENHANCEMENT FOR IMPROVED GOVERNANCE (SEIG)
In order for Tajikistan to prosper and develop as a country, the framework of a modern and effective state needs to be enhanced. Weak state structures create a government that allows private interests to take precedence over the public good. To degree of internal control within the state over its agents is a key factor in the state’s ability to protect its citizens from abuses of power by individual government employees.
In this regard UNDP Tajikistan Country Office implements through the State Enhancement for Improved Governance Project number of initiatives facilitating good governance, integrity in government agencies, promoting human rights, better public administration and enhancing transparency and accountability.
The Project is implemented through three main thematic areas:
• Transparency and Accountability. Assessments and trainings for increasing transparency and accountability of the system of governance and the Security Sector.
Through individual component activities project builds stronger integrity management systems at the national institutions level, particularly focused on specific intiatives that build the capacity of the Agency on State Financial Control and Fight against Corruption (Anticorruption Agency), the international aspect of the Government’s anti-corruption efforts as well as non-governmental sectors of civil society and private enterprise. For promoting these initiatives and reach necessary results Project focuses in preparing national partners for sustainable continuation of research work and continuing education curriculums for public officials and non governmental stake holders.
• Public Administration Reform. Capacity building for system of internal control and accountability within the Public Sector and promotioion of Effective Public Complaint Mechanism (PCM).
This component is carried out through the Office of Ombudsman which is well suited for operation of an effective public complaints mechanism. As the initial stage, the UNDP provided basic technical support to National Human Rights Institute. Presently, the project continues its support through capacity building of the staff. Special Consultant will facilitate the work of NHRI to intriduce well functioning Public Complaints Mechanism (PCM) The following areas are covered in establishment of Public Complaints Mechanism within Ombudsman Office:
- Capacity building of newly establishedf NHRI.
- Framework and identification of a model of public complaint mechanism (PCM);
- Provision and Publication of Educational Materials
- Networking with other Ombudsman offices.
• Judicial Reform. Promote newly adopted Criminal Procedures Code.
The goal of the project is to strengthen responsive government institutions by making the justice system more effective, responsive and accessible such that it promotes the rule of law. In particular, the project will disseminate the text of new CPC among its main partners and other law practitioners to effectively apply the law in accordance with international standards and obligations taken by Tajikistan. Strengthening the existing reform process through working within established institutions, UNDP will maximize the national ownership of these reforms and ensure their sustainability over time.
Strengthening Judicial Reform and Governance in Tajikistan
This project being SEIG subproject is designed to facilitate better governance in Tajikistan in order to enhance potential, promote protection of human rights and increase the core functions of the state, especially in the area of justice. The components of the project are:
- Penalty codes are mainstreamed into the activities of law enforcement bodies, judiciary, prosecutors, local governments and better understood by citizens.
- People’s Representative system is more representative and transparent in 3 pilot areas.
The following are the main activities that will be achieved:
- Conduction of trainings within judiciary, prosecutor’s office and police on integrity and accountability.
- Development, publication and distribution of bench books for judges and a book of template forms for law practitioners
- Publication and distribution of pamphlets on key legal issues for citizens
Each of those areas are an aspect to an effective state structure that is better able to provide the security, regulatory and territorial guardian aspects of a modern state that enables the citizens of Tajikistan to live secure and prosperous lives. This Programme has an indicative budget of 3 mln USD.
